General Terms and Conditions

1. scope and provider

These General Terms and Conditions (GTC) apply to all orders and sales placed via the online store westgem.store, operated by SAND GREEN OÜ, Narva maantee 5, 10117 Tallinn, Estonia ("we"). By placing an order, the customer accepts these GTC. Conflicting terms of the customer shall not become part of the contract unless we expressly agree to them in writing.

2. conclusion of contract

The presentation of products in the online store does not constitute a binding offer but merely an invitation to submit an order. By placing an order, the customer makes a binding offer. The contract is concluded as soon as we confirm the order by email or dispatch the goods. An automated acknowledgement of receipt does not yet constitute acceptance.

3. prices, shipping costs and delivery

All prices include the applicable statutory VAT. Additional costs - in particular shipping costs - are shown separately during the order process before the order is bindingly submitted. Delivery is made worldwide in accordance with the shipping zones and conditions stated in the store. Delivery dates are non-binding unless expressly agreed otherwise.

4. payment

The payment methods available in the store are displayed during the order process. We reserve the right to exclude individual payment methods in specific cases. For prepayment, we are entitled to dispatch the goods only after receipt of payment.

5 Retention of title

The goods remain our property until full payment has been received.

6. right of withdrawal

Consumers have the statutory right of withdrawal. The conditions, the period and the effects of withdrawal are set out in our separate withdrawal information at westgem.shop/rueckerstattung_rueckgaben.

7. warranty

Statutory warranty rights apply. In the event of a defect, the customer is entitled to statutory remedies including subsequent performance, withdrawal or price reduction as well as compensation for damages or expenses in accordance with statutory provisions.

8 Limitation of liability

We are liable without limitation for intent and gross negligence as well as under the Product Liability Act. For slight negligence we are only liable for breach of a material contractual obligation (cardinal obligation) and only up to the amount of the typical, foreseeable damage. Any further liability for slight negligence is excluded.

9. data protection

The collection and processing of personal data is carried out in accordance with our privacy notice at westgem.shop/datenschutz and applicable data protection laws (in particular GDPR and the Estonian Personal Data Protection Act).

10. brand history and heritage

The WESTGEM brand has existed since 1998 and stands for quality and expertise in minerals, crystals and fossils. It is now operated by SAND GREEN OÜ, continuing the original brand values. References to historical transactions or collection pieces serve to illustrate this long-standing tradition.

11. final provisions

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. Estonian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the state of the customer's habitual residence remain unaffected. Place of performance and exclusive place of jurisdiction for merchants is Tallinn, Estonia.
